Terms and Conditions for TMS (atamartialarts.co.za)

1. Eligibility

You must be at least 18 years old to create an account or make payments on the Site. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian, who will be responsible for all activities, including registrations and payments.

The Services are intended for participants, judges, club owners and organizers associated with ATA Martial Arts South Africa.

2. Account Registration

To access certain features, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials (username/email and password).
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

3. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. Permitted uses include:

• Registering for ATA Martial Arts tournaments and events.
• Submitting required personal and profile information (e.g., ATA Number, rank, club).
• Making payments for event registrations via our third-party processor, Yoco.

Prohibited activities include:

• Using the Services for any illegal or unauthorized purpose.
• Interfering with or disrupting the Site or Services (e.g., hacking, viruses, excessive automated access).
• Impersonating any person or entity.
• Submitting false or misleading information.
• Attempting to reverse engineer or extract source code from the Site.

4. Payments and Refunds

Payments for tournament/event registrations are processed securely through Yoco, our third-party payment provider. By making a payment, you agree to Yoco's terms and conditions (available on their website).

• All fees are non-refundable unless otherwise stated by the event organizer or required by applicable law (e.g., under South African consumer protection laws).
• We do not store your payment card details; these are handled by Yoco.
• Event organizers (ATA Martial Arts SA) set registration fees and any refund policies specific to events.

5. Intellectual Property

The Site and its content (including design, text, graphics, logos, and software) are owned by us or our licensors and protected by copyright and other laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without our prior written consent.

User-submitted content (e.g., profile information) remains your property, but you grant us a worldwide, royalty-free license to use, store, and process it as necessary to provide the Services.

6. Disclaimer of Warranties

The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Services will be uninterrupted, error-free, secure, or compatible with your device.

7. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or Services.

Our total liability shall not exceed the amount you paid (if any) for the specific event or service in question.

This limitation applies even if we have been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages (including legal fees) arising from your violation of these Terms, your use of the Services, or your submitted content.

9. Termination

We may terminate or suspend your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your account and access to Services will cease, but provisions regarding liability, indemnification, and disputes will survive.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.

Any disputes arising from these Terms or the Services shall be resolved exclusively in the courts of South Africa.
